Terms of Service

Please read these terms carefully before using ScubaDiverLink

These Terms of Service ("Terms") govern your use of the ScubaDiverLink platform, operated by 2274638 Ontario Inc. ("ScubaDiverLink", "we", "us", "our"), a corporation incorporated under the laws of Ontario, Canada. By creating an account or using our platform, you agree to these Terms.

1. The Platform

ScubaDiverLink is a marketplace that connects scuba divers with dive charter operators, dive shops, and dive guides. We are not a dive operator, shop, or guide ourselves — we provide the technology platform that enables these transactions. All diving activities booked through ScubaDiverLink are provided by independent third-party operators who are solely responsible for the safety, quality, and legality of their services.

2. Eligibility

  • You must be at least 18 years of age to create an account
  • You must have the legal capacity to enter into binding agreements
  • Business accounts must represent a legitimately operating business
  • You may not create multiple accounts or accounts on behalf of others without authorization

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@scubadiverlink.com if you suspect unauthorized access to your account.

4. User Roles

Divers

Diver accounts are free. Divers may browse listings, make bookings, leave verified reviews, upload certifications, and use all diver-facing platform features. By booking a trip, you agree to the operator's cancellation and refund policy disclosed at the time of booking.

Operators and Dive Shops

Business accounts require a paid subscription (Standard or Premium). Operators and shops are responsible for accurately representing their services, maintaining required licenses and insurance, and complying with all applicable local laws and safety standards. ScubaDiverLink reserves the right to verify business legitimacy and suspend accounts that misrepresent their services.

Dive Guides

Guide accounts may be free or paid (Premium). Guides are independent contractors and are not employees of ScubaDiverLink. Guides are responsible for maintaining their own certifications, insurance, and legal compliance.

5. Bookings and Payments

All payments are processed by Stripe, Inc. ScubaDiverLink charges an 8% platform fee on confirmed bookings, deducted before payout to operators. Operators receive payouts via Stripe Connect according to the Stripe payout schedule.

Refunds are subject to the individual operator's cancellation policy. In the event of a harbour closure or force majeure event recorded on the platform, ScubaDiverLink will facilitate refund processing in accordance with the platform's refund policy.

ScubaDiverLink is not responsible for disputes between divers and operators. We may, at our discretion, mediate disputes but are not obligated to do so.

6. Safety and Liability Waivers

Scuba diving is an inherently risky activity. Prior to participating in any dive trip booked through our platform, you may be required to sign a liability waiver provided by the operator. Electronic signatures captured through our platform are legally binding. ScubaDiverLink, its affiliates, officers, and employees are not liable for any injury, death, loss, or damage arising from dive activities booked through the platform.

You represent that you are medically fit to dive and hold a valid certification appropriate for the activities booked. ScubaDiverLink does not verify diver fitness for specific activities beyond certification level.

7. Reviews and Content

Reviews submitted through ScubaDiverLink must be honest and based on actual experience. Fake, defamatory, or incentivized reviews are prohibited. ScubaDiverLink reserves the right to remove reviews that violate these Terms. By submitting content (reviews, photos, messages), you grant ScubaDiverLink a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with platform operations.

8. Prohibited Activities

  • Circumventing the platform to book or pay outside of ScubaDiverLink
  • Creating fake listings, fake reviews, or misrepresenting credentials
  • Harassing, threatening, or discriminating against any user
  • Using the platform for any illegal purpose
  • Scraping, reverse-engineering, or attempting to access our systems without authorization
  • Uploading malicious code, spam, or unsolicited communications

9. Subscriptions and Billing

Business subscriptions are billed monthly or annually in advance. You may cancel your subscription at any time — cancellation takes effect at the end of the current billing period with no partial refunds. ScubaDiverLink reserves the right to modify pricing with 30 days' notice.

10. Intellectual Property

The ScubaDiverLink platform, including its software, design, trademarks, and content, is owned by 2274638 Ontario Inc. and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

11. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCUBADIVERLINK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. SCUBADIVERLINK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO SCUBADIVERLINK IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) CAD $100.

12. Indemnification

You agree to indemnify and hold harmless ScubaDiverLink, its affiliates, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved by binding arbitration in Ontario, Canada, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes. Continued use of the platform after changes take effect constitutes acceptance.
